UCC-1

UCC-1

Postby Sibs » Wed Dec 30, 2009 9:38 am

Hi all, I'm interested in the UK version of the UCC-1 financing statement, do we even have a UK version?! I'm of the overstanding that by definition the same would be suitable for all but I would just like to be sure. Also, I would like to know what the differences would be in section 4 " This FINANCING STATEMENT covers the following collateral: when applying it to the UK. :8-):

Thank you in advance for any help on the topic..

According to Ewan McKendrick (Contract Law, 3rd ed 2008, page 94) the UCC is the American commercial law. In Europe there is
The Vienna Convention on Contracts for the International Sale of Goods
Unidroit Principles of International Commercial Contracts
Uniform Law on the Formation of Contracts.
If you want to go through the Ucc, then you can do but judges here are saying it's a foreign jurisdiction. One way round that is to complete the UCC process then publish in Britain. Get a certificate of publication. The Rules of Evidence state that anything that has been published in the press is acceptable in a British court.
PPSA, as has been said, is the Brit way.
Good luck

All this is doing is pinning the strawman against itself, it does nothing.

Maxim of law:

Disparata non debent jungi ; Unequal things ought not to be joined. Jenk. Cent. 24.

People who use this think they the man are making a claim on the strawman... NOT.
Rumor has it somebody scored big time using this, around 1.6 million many years ago
and now the blind follow the blind on the merry-go-round all this time.
Since I have been in this movement late yr./2000 have not met anyone or seen proof anyone
has actually done such a thing.
