UNIDROIT Applicability

UNIDROIT Applicability

Postby laughingcat » Mon Apr 12, 2010 6:09 pm

When we are sending notices asking for Adequate Assurance of Due Performance, we are using the UNIDROIT principles. If one reads the UNIDROIT website it states that UNIDROIT's purpose is in "co-ordinating private and in particular commercial law as between States and groups of States". Can anyone confirm that it is applicable to be using UNIDROIT in these private contracts that are obviously not international agreements between States? I'd just like to be clear on this. FMOTL Michael has made extensive use of this, so I'm sure he'll know the answer and indeed it might have been discussed elsewhere on the forum but i can't find it. Could be an important point as I can just imagine the CC company writing back saying that UNIDROIT is not applicable etc.

Interested to see what you get back from this. Best to see what they come back with before you predict it, if this is the first time you've tried using the UNIDROIT principles.

Good luck - I'll keep an eye on this thread :)
